Warren E. Berbit


Warren E. Berbit joined Jaspan Schlesinger as a partner effective February 1, 2014.  His is located at the Firm’s Suffern, New York office.

Mr. Berbit is a former electrical engineer with a B.S. (E.E.) from the City College School of Engineering and an M.S. (E.E.) from New York University. As an engineer, Mr. Berbit helped design a classified navigation system for the military and test flew with the system for three years during the Vietnam era. During this time he rose to Senior Engineer at the Sperry Gyroscope Co., and then continued at that level with the Bendix Corp.

Mr. Berbit then attended Fordham Law School, graduating in 1973. Upon admission to the Bar in 1974, he began practicing law as an attorney with Lexow & Jenkins, which he had been serving as a Law Clerk since 1971. He became a partner in 1977. The firm evolved into Lexow, Berbit & Assoc., P.C. in 1994, with Mr. Berbit becoming the Principal Attorney. The firm and its predecessors, extant since 1895 and connected to historically significant personages and events, has included the Clarkstown Central School District as a client since centralization in 1949, and the component districts back to the early 1900’s.

Mr. Berbit specializes in education and municipal law. He has been General Counsel to the Clarkstown Central School District since 1978. He also helped form the Village of Montebello, has served as Village Attorney since its incorporation in 1986, and has served as a consultant to other villages and villages-in-formation. The Village honored him in 2012 by dedicating the 12-acre Warren E. Berbit Nature Preserve. Similarly, in 2012 he was awarded a “Certificate of Public Service” by New York State Conference of Mayors and Public Officials, “In Recognition Of Twenty-Five Years Of Distinguished Public Service To [His] Community.”

Over the course of his career, Mr. Berbit has litigated numerous education law and related issues before the Commissioner of Education, PERB, NYS Division of Human Rights, New York Supreme Courts, Appellate Divisions and Court of Appeals, U.S. District Courts and the Second Circuit Court of Appeals. He has lectured on education law, in general, and on topics such as student rights, student discipline, and probation and tenure of pedagogical employees. He has also presented on land use regulations and zoning law. He is admitted to practice before the Courts of New York State, the United States District Courts for the Eastern and Southern Districts of New York, the Second Circuit Court of Appeals, and the United States Supreme Court.

Mr. Berbit’s public service includes serving as an elected Trustee of the Suffern Free Library since 1996,  and as Vice President since 2004. He is a Director of the Legal Aid Society and is a member of the Judicial Screening Committee of the Rockland County Bar Association. In 2011, that Association bestowed the Joseph Balsamo Lifetime Achievement Award upon him, given in recognition of “significant respect from the members of the Bar and the public for his personal and professional contributions to both, while maintaining the highest form of integrity and professionalism while advocating for each.”
