Litigation & Municipal Partner Laurel R. Kretzing wins Constitutional Rights Case 


In the matter of Lyn v. The Village of Hempstead,  after lengthy proceedings in the Eastern District of New York and an appeal before the United States Court of Appeals for the Second Circuit, Litigation & Municipal Partner Laurel R. Kretzing received a judgment in favor of the defendant, the Incorporated Village of Hempstead, in a case involving allegations that the Village had violated the constitutional rights of a local night club and its owner.

The Village had revoked the business license of the club owner after the Village Police Department was forced to respond to hundreds of complaints arising from events at the nightclub.  Numerous shootings and stabbings were reported. The club owner brought suit in the Eastern District of New York alleging that his First Amendment rights to freedom of speech and freedom of assembly were violated by the revocation of the business license.  The District Court granted summary judgment to Village finding that the club owner had failed to establish that any of his constitutional right had been violated. The club owner appealed. The Second Circuit Court of Appeals affirmed the District Court, a total defense victory.
